Terms & Conditions
The agreement between your family and Legacy, Love & Learning. We've written it as plainly as we can.
These Terms & Conditions (Terms) govern the purchase and use of the Legacy, Love & Learning online membership, programs, resources and related digital content (Services). By purchasing a membership or using the Services, you agree to these Terms.
1. About Legacy, Love & Learning
Legacy, Love & Learning is an Australian-based, parent-facing educational business. The Services are designed to help parents and carers create and recognise learning opportunities through everyday family life.
The Services are supplementary educational resources. They are not a school, childcare service, tutoring guarantee, medical service, allied-health service, developmental assessment service or substitute for individual professional advice.
2. Adult account holders and child participation
Membership accounts are intended for adults aged 18 years or over. A parent, guardian or other authorised adult must create, manage and control the account.
Children may participate in activities selected and supervised by the adult account holder, but children must not create independent accounts, provide payment information or communicate independently with Legacy, Love & Learning unless we expressly introduce a child-facing feature with appropriate safeguards.
Please provide only the minimum child information reasonably requested by the Services. Unless a feature specifically requires it, do not upload sensitive information, photographs, school records, health information or precise location data about a child.
3. Membership, access and program content
The membership inclusions, program level, billing period and price shown at checkout form part of your contract with us. Features may include parent guidance, learning activities, downloadable or printable resources, videos, emails, prompts, progress tools and other educational materials.
We may improve, replace or update individual resources over time. We will not make a material negative change to a paid fixed-term membership without giving reasonable notice and any remedy required by applicable consumer law.
3A. Term structure and tier changes
Enrolment is by fixed term (currently 10 weeks). You may move between commitment tiers (Seedlings, Growers, Bloomers) within the first two (2) weeks of the start of a term; requests made after that window will not be actioned until the following term. Enrolling in a term is a commitment to that full term — see clause 6 (Changing tiers and leaving the program) and our Cancellation & Refund Policy for how cancellation, non-renewal and statutory rights apply.
4. Pricing, currencies and taxes
Prices are displayed in the currency stated at checkout. Your bank or payment provider may charge foreign exchange or international transaction fees, which are outside our control.
Payments are processed via Stripe.
Taxes will be charged or included where legally required. Australian GST, New Zealand GST and United Kingdom VAT treatment may differ depending on the customer, the nature of the supply and applicable registration rules.
If sales to New Zealand consumers exceed the GST registration threshold for offshore suppliers of remote services under New Zealand law, we will register for New Zealand GST and include it in the displayed price as required.
As a non-UK business, we will register for UK VAT before our first sale to a UK consumer and include UK VAT in the displayed price as required by law.
If a tax becomes legally payable or the applicable rate changes, we may adjust future prices after giving any notice required by law. We will not retrospectively increase a completed payment.
5. Terms, fees and payment
5.1 Legacy programs run in terms of 10 weeks. When you enrol, you are enrolling for a full term, and the term fee for your chosen tier is shown at checkout before you pay.
5.2 You can choose to pay the full term fee upfront, or in weekly instalments. Paying upfront for the full term includes a small discount, shown at checkout. Weekly instalments are a way of spreading the cost of the term. They are not a week-to-week subscription, and the full term fee is still payable if you choose to pay weekly.
5.3 Payments are processed securely through Stripe. Legacy, Love & Learning is not currently registered for GST, so our prices don't include GST. If we register in future, we'll let you know before it affects your fees.
5.4 Next term. About 14 days before each new term begins, we'll email you a friendly reminder with the dates and fee for the next term. If you'd like to continue, you don't need to do anything, and your enrolment will carry over. If you'd prefer not to continue, just let us know in writing before the new term starts.
5A. If a payment doesn't go through
5A.1 Sometimes payments don't go through. If that happens, we'll try again and let you know by email, so you have a chance to update your details.
5A.2 You'll have a grace period of 7 days from that email to make the payment. Your access continues during the grace period.
5A.3 If the payment is still outstanding after the grace period, we may pause your access until it is paid. The remaining fees for the term are still payable.
5A.4 If you're finding payments difficult, please talk to us. We're happy to discuss a reasonable payment arrangement.
6. Changing tiers and leaving the program
6.1 Changing tiers. You can move to a different tier (Seedlings, Growers or Bloomers) during the first two weeks of a term. Any difference in fees will be adjusted for the rest of the term. Tier changes aren't available after week two.
6.2 During a term. Because each term is planned as a complete 10-week learning journey, memberships can't be cancelled part-way through a term, and the full term fee remains payable. This doesn't affect your rights under consumer law (see clause 8) or our exceptional circumstances approach (see clause 6A).
6.3 At the end of a term. You're welcome to finish at the end of any term. Just let us know in writing, by email to hello@legacyloveandlearning.com, before the next term begins, so we both have a clear record.
6.4 Deposits. Where a deposit is paid to hold a place, it is credited toward your term fee. It can be refunded if you let us know in writing at least four weeks before the term starts. After that, the deposit isn't refundable, except where consumer law or clause 6A applies.
6A. Exceptional circumstances
6A.1 We understand that life sometimes changes in ways no one can plan for. If something serious happens, such as a bereavement, a serious illness or significant hardship, please contact us in writing.
6A.2 Legacy, Love & Learning reserves the right to make discretionary decisions regarding refunds, credits, pauses, transfers or other arrangements in exceptional circumstances. We'll consider each request fairly, case by case, and may ask for reasonable information to help us understand the situation.
6A.3 A decision made in one case doesn't create an entitlement to the same outcome in another, and this clause doesn't limit your rights under consumer law.
7. United Kingdom cancellation rights and immediate digital access
UK consumers may have statutory cancellation rights for distance contracts. Where the law requires it, we will provide the required pre-contract information and a contract confirmation in a durable format such as email.
When it comes into force (expected in 2027), UK subscription contracts are additionally governed by the Digital Markets, Competition and Consumers Act 2024 subscription contracts regime. Where that regime applies, we will provide the prescribed pre-contract information, renewal reminders, and cancellation mechanism it requires, including any additional cooling-off period following a renewal charge.
If you ask us to supply qualifying digital content immediately during a statutory cancellation period, checkout may require you to expressly consent to immediate supply and acknowledge the effect this can have on your right to cancel once supply begins. We will only rely on that consent where the legal requirements have been met and recorded.
If the Services are legally treated as services rather than digital content, different rules may apply to work started during a cooling-off period. Nothing in these Terms reduces any non-excludable UK consumer right.
8. Refunds and statutory consumer guarantees
Our Cancellation & Refund Policy forms part of these Terms. It does not exclude statutory rights.
Australia
Australian consumers may have rights and remedies under the Australian Consumer Law, including consumer guarantees that cannot be excluded by contract.
New Zealand
New Zealand consumers may have rights and remedies under the Consumer Guarantees Act 1993 and Fair Trading Act 1986 that cannot be excluded where those laws apply.
United Kingdom
UK consumers may have rights under the Consumer Rights Act 2015, the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 and other applicable consumer protection legislation.
8A. Unfair trading practices (Australia)
From 1 July 2027, the Australian Consumer Law prohibits unfair trading practices, including conduct that unreasonably manipulates or unduly pressures a consumer, unclear or hidden pricing, and cancellation or non-renewal processes that are disproportionately harder than the sign-up process. We design our enrolment, tier-change, pricing and cancellation processes to disclose all material terms before purchase and to make cancellation/non-renewal no harder than enrolling. This clause and our processes will be reviewed for compliance ahead of the 1 July 2027 commencement.
9. Founding family discount and other offers
9.1 Founding family pricing is offered to the first 20 families to confirm their enrolment. Founding families receive 20% off the standard price of every Legacy program and tier (rounded down to the nearest dollar), for every child in the family, for as long as at least one child stays continuously enrolled with Legacy.
9.2 Continuously enrolled means at least one child in the family is enrolled in every term, one after another, without the family finishing or leaving between terms. Legacy's own scheduled breaks between terms don't count as a gap.
9.3 Moving up the ladder. When a child moves up to the next Legacy program (for example, from Leap into Legacy to Lift Off), the 20% founding-family discount carries over and applies to the new program's standard price for the chosen tier.
9.4 Missed payments. If a payment is missed but made within the grace period in clause 5A, the founding-family discount continues. If the payment is not made and the membership ends, the discount ends.
9.5 Changing tiers and adding siblings. If a founding family changes tier, or enrols a brother or sister, the 20% discount applies to the standard price of that program and tier.
9.6 Taking a break. Where a family's circumstances genuinely require a pause, such as a death in the family or family hardship, a founding family may take a break of one term per year and keep their founding-family discount when they return. Please let us know in writing before the term starts. This isn't counted as leaving under clause 9.2.
9.7 If a founding family finishes at the end of a term, other than for a break under clause 9.6, the founding-family discount ends, and any future enrolment is at the standard price at that time.
9.8 Other offers. Any introductory, trial or promotional offer will state its eligibility, price, duration, renewal price and material conditions before purchase.
10. Intellectual property and family-use licence
Unless stated otherwise, all program names, text, graphics, videos, activity instructions, downloads, worksheets, templates and other materials are owned by or licensed to Legacy, Love & Learning and are protected by intellectual property laws.
A paid membership gives the account holder a limited, non-exclusive, non-transferable licence to access the Services and use permitted resources privately within their household for personal, non-commercial purposes during the applicable access period.
- You may print permitted resources for use with children in your own household.
- You must not resell, sublicense, publicly upload, share login credentials outside the permitted household, reproduce resources for a school/centre/business, remove rights notices, or use the materials to create a competing product without written permission.
- Educators, centres, schools or other organisations require any separate licence that we specify for organisational use.
11. Parent supervision and safe use
The adult account holder is responsible for selecting activities that are appropriate for the child's age, abilities, environment and circumstances, and for providing active supervision where reasonably required.
Do not use an activity if the materials, food, movement, location or equipment are unsuitable for the child. Follow manufacturer safety instructions for any third-party product used in an activity.
12. No guaranteed educational outcome
Children develop at different rates and learn in different ways. We do not promise or guarantee that a child will achieve a particular school-readiness, literacy, numeracy, behavioural, developmental or academic outcome by using the Services.
Any examples, testimonials or educational claims describe intended support, experiences or individual results and are not guarantees of identical outcomes for every family.
13. Third-party platforms and links
We may use third-party providers for website hosting, payment processing, email delivery, analytics, video, file storage or other functions. Their separate terms and privacy practices may apply to their services. We are not responsible for content on independent third-party websites that we do not control.
14. Service availability
We aim to provide reliable access but cannot guarantee uninterrupted availability. Maintenance, internet outages, third-party platform failures or events outside reasonable control may temporarily affect access. Where a prolonged outage materially affects a paid service, we will provide any remedy required by applicable law and may provide a reasonable discretionary remedy in other cases.
15. Acceptable use and account security
- Keep your password confidential and notify us promptly if you suspect unauthorised access.
- Do not attempt to bypass security, scrape or systematically copy the platform, interfere with other users, introduce malicious code or use the Services unlawfully.
- Do not upload unlawful, harmful or rights-infringing material.
16. Privacy and communications
Our Privacy Policy explains how we handle personal information. Transactional communications necessary to administer your membership may be sent without separate marketing consent where permitted by law. Marketing communications are handled separately and include an unsubscribe method where required.
16A. Research
16A.1 From time to time, Legacy's founder may invite families to take part in doctoral research about how families learn together at home. Taking part is completely optional and is handled through a separate consent form.
16A.2 Your membership, program and experience with Legacy are the same whether or not you choose to take part.
16B. Images and voices
16B.1 Legacy doesn't publish children's faces or identifiable voices. Any photos or recordings families choose to share are used only with written consent and in line with our faceless image approach.
17. Suspension and termination
We may suspend or terminate access where reasonably necessary because of fraud, serious misuse, unlawful activity, security risk or a material breach of these Terms. Where appropriate, we will give notice and a reasonable opportunity to remedy the issue.
We will not use termination rights in a way that removes statutory consumer remedies or unfairly deprives a consumer of prepaid access without an appropriate refund or other remedy where required by law.
18. Liability and non-excludable rights
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, statutory right or liability that cannot legally be excluded, restricted or modified.
To the extent permitted by law, we are not liable for indirect or consequential loss that was not reasonably foreseeable when the contract was made, or for loss caused by misuse of the Services, failure to follow safety instructions, or events outside our reasonable control.
Any limitation in these Terms is subject to the consumer protection laws that apply to you.
19. Complaints and dispute resolution
If you have a concern, please contact hello@legacyloveandlearning.com with your name, account email, order details and a description of the issue. We will try to resolve complaints fairly and within a reasonable time.
You remain free to use any external complaint, regulator, tribunal or court process available to you under applicable law.
20. Governing law and international consumers
These Terms are governed by the laws of Queensland, Australia, except to the extent mandatory laws in your country of residence apply and cannot lawfully be displaced. Nothing in this clause is intended to prevent an Australian, New Zealand or UK consumer from relying on mandatory consumer protections or bringing a claim in a forum available to them by law.
21. Changes to these Terms
We may update these Terms to reflect changes to the Services, law, security or business operations. If a change materially affects an existing paid membership, we will give reasonable advance notice and any cancellation or other rights required by law. The version in force when you make a purchase applies to that purchase subject to lawful later changes.
